Welcome to Livd. These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and services provided by Livd Homes, Inc. ("Livd," "we," "us," or "our"), including livdhomes.com (the "Site"), the Livd mobile app (the "App"), and the home maintenance subscription services we provide (collectively, the "Service").

By creating an account, signing a Service Agreement, or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we'll let you know by email, in-app notice, or by posting an update on the Site, and we'll update the "Last updated" date at the top of this page. Continued use of the Service after a change takes effect means you accept the new Terms. If you don't agree, you can stop using the Service and cancel your membership.

2. The Service

Livd provides a home maintenance subscription that pairs you with a dedicated handyman for recurring visits, proactive maintenance planning, and coordination with vetted local partners for work outside handyman scope.

2.1 What's covered

The specific services included in your membership, visit counts, and pricing are described in your Service Agreement and on livdhomes.com/pricing. Examples of common handyman services include furniture assembly, fixture installation, drywall patching, gutter cleaning, appliance maintenance, and weather stripping. The full scope is set in your Service Agreement.

2.2 Special Projects

Some of the tasks you need done in your home require a licensed tradesperson (plumbing, electrical, HVAC, roofing, and similar) or otherwise fall outside of the standard handyman scope. When that's the case, we'll connect you with a vetted partner from our local network to do the work as a Special Project. Livd coordinates the introduction and acts as your advocate, but the work itself is performed by the partner under their own agreement with you, and is warrantied by the partner. Livd is not responsible for the quality, timeliness, or outcome of partner work.

3. Eligibility and Accounts

You must be at least 18 years old and a homeowner (or have authority to make decisions about home maintenance for the property where service will be performed) to use the Service. You agree to provide accurate, current, and complete information when creating your account, and to keep that information up to date.

You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at hello@livdhomes.com if you suspect unauthorized use.

4. Membership and Service Agreement

Use of Livd's home maintenance services requires an active membership and a signed Service Agreement. The Service Agreement governs your specific membership terms — including your plan, billing schedule, payment authorization, scope of services, and cancellation rights. If anything in these Terms conflicts with your Service Agreement, your Service Agreement controls for matters specific to your membership.

5. Fees, Billing, and Payment

5.1 Subscription fees

Membership fees are billed according to the plan you select in your Service Agreement. Monthly plans are billed on the first of each month. Annual plans are billed in full at sign-up and at each annual renewal.

5.2 Additional charges

In addition to your membership fee, you may be charged for: extra visits beyond your plan, parts and materials approved or pre-authorized in your Service Agreement, the per-visit shopping fee when we source materials, and any third-party partner work you authorize through Livd. All charges are itemized.

5.3 Payment processing

LIVD DOES NOT DIRECTLY PROCESS PAYMENT FOR ANY SERVICES. We use third-party payment processors (collectively, “Payment Processor”) to facilitate all payments. These services are subject to the applicable Payment Processor’s terms, conditions, and privacy policies (the “Payment Processor Agreements”). By using the Service, you agree to be bound by the applicable Payment Processor Agreements. Livd assumes no liability or responsibility for any payments you make through the Service. Livd does not store your full bank account or card details on its own servers.

5.4 Price changes

We may change pricing for the Service. If we do, we'll give you at least 30 days' notice by email or in-app message before the change takes effect. If you don't agree to the new pricing, you can cancel your membership before the change takes effect, in accordance with the cancellation terms in your Service Agreement.

5.5 Disputes and chargebacks

If you believe a charge is incorrect, please contact us at support@livdhomes.com within 60 days so we can resolve it directly. We'd much rather sort it out with you than through a card dispute.

6. Cancellation and Refunds

You can cancel your Livd subscription by emailing support@livdhomes.com

If Livd isn’t a fit for you in your first 30 days, you will receive a full refund in accordance to our 30 Day Money Back guarantee policy. 

No refunds will be issued after the initial 30-day period. 

If you’re on a monthly plan, your membership won’t renew the following month, and you will have through the end of your current paid month to use remaining or banked visits. 

If you’re on an annual plan, your membership won’t renew the following year, and you will have through the end of your subscription period to use remaining credits. 

7. Customer Responsibilities

To get the most out of Livd and keep visits running smoothly, you agree to:

  • Provide safe access to your home for scheduled visits
  • Restrain pets during visits
  • Disclose any known hazards (active leaks, exposed wiring, structural issues) at the time of booking
  • Keep your payment method on file current
  • Use the Service for lawful, residential home maintenance purposes only

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose
  • Misrepresent your identity or affiliation with any person or entity
  • Harass, threaten, or mistreat Livd employees, contractors, or partners
  • Attempt to gain unauthorized access to the Site, App, or any Livd systems
  • Interfere with or disrupt the Service, including by introducing malware or scraping data
  • Reverse engineer, copy, or create derivative works of the Site, App, or any Livd software
  • Use the Service if you are a competitor of Livd, except with our prior written consent

We may suspend or terminate your account if you violate these rules, and may report unlawful activity to authorities.

9. Mobile App License

Subject to your compliance with these Terms, Livd grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Livd App on devices you own or control, solely to access and use the Service for your personal, non-commercial home maintenance needs.

9.1 App store terms

If you download the App through the Apple App Store or Google Play, you also agree to the applicable app store's terms. Apple and Google are not parties to these Terms, but Apple is a third-party beneficiary of these Terms with respect to the iOS version of the App and may enforce them as such. Apple and Google have no responsibility for the App or any Livd services, and no obligation to provide support or maintenance.

9.2 SMS and notifications

By using the Service, you consent to receive service-related communications from Livd by email, SMS, push notification, and through the App. Standard message and data rates from your carrier may apply. Message frequency varies, and you will receive messages on a frequency ranging from daily to weekly. You can opt out of marketing messages at any time by texting "STOP" to the phone number from which you received the message. For assistance, text "HELP" to the same number. Carriers are not liable for delayed or undelivered messages. Opting out won't affect mandatory service-related communications.

10. Intellectual Property

10.1 Livd content

The Site, App, and all content, features, software, designs, and trademarks within them (collectively, "Livd Content") are owned by Livd or its licensors and are protected by copyright, trademark, and other laws. The name "Livd," the Livd logo, and related branding are trademarks of Livd Homes, Inc. You may not use them without our prior written permission.

10.2 Your content

You retain ownership of any photos, notes, messages, or other content you submit through the Service ("User Content"). By submitting User Content, you grant Livd a worldwide, non-exclusive, unrestricted, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, copy, reproduce, modify, publish, distribute, display, perform, and create derivative works of your User Content, in any media or format now known or hereafter developed, for the purpose of operating, providing, and improving the Service, and for the promotion, advertising, and marketing of the Service.

10.3 Feedback

If you send us suggestions, ideas, or feedback about the Service, we may use them without any obligation to you.

11. Privacy

Our Privacy Policy, available at livdhomes.com/privacy-policy, describes how we collect, use, and share information about you. By using the Service, you consent to our practices as described there.

12. Disclaimers

THE SITE AND APP ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EXCEPT AS EXPRESSLY PROVIDED IN YOUR SERVICE AGREEMENT, LIVD DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

LIVD DOES NOT WARRANT THAT THE SITE OR APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT INFORMATION OBTAINED THROUGH THEM WILL BE ACCURATE OR RELIABLE; OR THAT ANY DEFECTS WILL BE CORRECTED. LIVD IS NOT RESPONSIBLE FOR THE WORK OR CONDUCT OF PARTNERS, AND ANY WARRANTY RELATED TO PARTNER WORK IS PROVIDED BY THE PARTNER, NOT LIVD.

Nothing in this section limits any non-waivable rights you have under California consumer protection law, or limits Livd's responsibilities under the Service Agreement for the work its own employees perform.

13. Indemnification

You agree to defend, indemnify, and hold harmless Livd, its affiliates, and its and their respective officers, employees, directors, service providers, licensors, and agents (collectively, the “Livd Parties”) from and against any and all losses, damages, expenses, including reasonable attorneys’ fees, claims, demands, and injuries (including death) arising out of or relating to: (a) your use of the Service; (b) any User Content you submit; (c) your connection to the Service; (d) your violation of these Terms; or (e) your violation of any rights of another party. Livd reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with Livd in asserting any available defenses. You may not settle any claim without Livd’s prior written consent. If you are a California resident, you waive California Civil Code Section 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or releasing party.”

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVD AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF LIVD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

LIVD'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID LIVD IN THE SIX (6) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent the limitations above are not enforceable in your jurisdiction, they apply only to the maximum extent permitted by law.

15. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND LIVD TO RESOLVE DISPUTES BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS AND LIMITS YOUR RIGHTS TO BRING CLASS ACTIONS OR JURY TRIALS.

15.1 Informal resolution

Before filing any claim, you agree to first contact us at hello@livdhomes.com and try to resolve the dispute informally. We commit to working with you in good faith for at least 60 days. Most issues can be resolved this way.

15.2 Binding arbitration

If we can't resolve a dispute informally within 60 days, you and Livd agree to resolve any claim arising out of or relating to these Terms or the Service through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in San Diego County, California, unless the parties agree otherwise. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

15.3 Class action waiver

YOU AND LIVD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS PROCEEDING.

15.4 Exceptions

You may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court for misuse of intellectual property. Nothing in this section prevents you from contacting a government agency about a dispute.

15.5 Opt-out

You may opt out of this arbitration agreement by emailing legal@livdhomes.com within 30 days of first agreeing to these Terms, with the subject line "Arbitration Opt-Out" and including your name and account email. Opting out won't affect any other part of these Terms.

16. Termination

You can stop using the Service and cancel your membership at any time according to your Service Agreement. We may suspend or terminate your account if you materially breach these Terms or your Service Agreement, if your payment method fails repeatedly, or if we discontinue the Service. We'll give you reasonable notice when feasible. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, arbitration, and these general provisions — will survive.

17. General

17.1 Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Subject to the arbitration agreement above, any claims not subject to arbitration will be brought in the state or federal courts located in San Diego County, California.

17.2 Entire agreement

These Terms, together with your Service Agreement and our Privacy Policy, are the entire agreement between you and Livd regarding the Service. They replace any prior agreements between us on the same subject.

17.3 No waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

17.4 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

17.5 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate, successor, or in connection with a merger, acquisition, or sale of assets.

17.6 Notices to California users

Under California Civil Code Section 1789.3, California residents are entitled to the following notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted by mail at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
